Eduardo Vielma Luengo, a construction worker, was murdered on September 4, 1986, at Avenida Ossa and Calle Cerro Negro during a national day of protest on that date. Recently, the Supreme Court convicted five Carabineros, now retired, as the perpetrator and accessories to this homicide.
The uniformed officers belonged to the 10th Precinct of La Cisterna, in the Metropolitan Region, and their sentences were established as follows: Juan Tapia Pacheco received 8 years in prison as the perpetrator of the crime; Jorge Escobar Cantillana and Carlos Ruiz Medrano received 541 days in prison, with the benefit of conditional remission, for their responsibility as accessories; and Víctor Geraldino González and Luis Zapata Torres received 100 days in prison for the same degree of participation.
The country's highest judicial body, while not confirming the sentence for qualified homicide previously established by the San Miguel Court of Appeals, determined: "That, as noted from the reading of the twenty-first finding of the appealed judgment, the facts established in relation to the crime of simple homicide of the victim Eduardo German Vielma Luengo have the character of a crime against humanity, in accordance with the principles and norms that inform International Humanitarian Law."
