Case Rol: 6.202 of the Second Court of Letters of Quillota: Case of Jorge Eduardo Villarroel Vilches

Seventh : That by virtue of the aforementioned reasoning, the opinion of the Judicial Prosecutor in her report on page 779 is dissented from regarding the confirmation of the appealed sentence without modifications.- And having seen, furthermore, the provisions of articles 510, 514, and 527 of the Code of Penal Procedure and what has been repeatedly resolved by jurisprudence on the matter, the first-instance sentence issued on January 10, 2005, and written from page 754 to page 766 verso, is confirmed, with the declaration that Sergio Placencia Sepúlveda, Laureano Enrique Hernández Araya, and José René Velásquez Núñez are convicted as co-perpetrators of the crime of aggravated kidnapping, provided for and sanctioned in article 141 of the Penal Code, against the person of Jorge Eduardo Villarroel Vilches, committed in San Pedro, Quillota, starting on April 19, 1974, each to suffer the corporal penalty of three years and one day of minor imprisonment in its maximum degree, which carries as an accessory the penalty of article 30 of the Penal Code, that is, the suspension of public office or position during the time of the sentence and to pay the costs of the case.- Likewise, it is declared that the convicted persons are granted the benefit of supervised release contemplated in article 15 of Law 18.216, and they must comply with the conditions established in article 17 of said legal body, remaining subject to a period of treatment and observation equal to the duration of the imposed sentence.-
