Tomás Ricardo Martínez Celis died that day at 18:50 hours, at Calle Alvarez de Toledo No. 500, in the commune of San Miguel, due to right pulmonary, hepatic, and cardiac trauma caused by a bullet, with an exit wound, as recorded in the Medical Death Certificate from the Legal Medical Institute.
According to statements from witnesses to the events and records from the judicial proceedings, on that day, at approximately 19:00 hours, Tomás Martínez was riding his bicycle along Calle Alvarez de Toledo.
Under those circumstances, he was struck in the back by a bullet fired by a motorized Carabineros officer who was in pursuit of three robbery suspects. His body was transported in a police tow truck to the Hospital Barros Luco, where it remained until the following day, when it was sent to the Legal Medical Institute.
A case was opened regarding these events at the Third Military Prosecutor's Office of Santiago, which was totally and definitively dismissed after the Tribunal determined that it was proven the police officer acted in self-defense.
The Superior Council, considering that the officer involved used his firearm without regard for its power and without anticipating the consequences that the shots could cause, reached the conviction that Tomás Ricardo Martínez Celis was a victim of human rights violations by State agents who made irrational use of force.
