Case No. 78-2010: Qualified homicide case of Arcadia Patricia Flores Pérez

I.- 6) Testimony of Sergio Hernando Oviedo Torres, from page 30, Chief Commissioner of the Assault Investigation Brigade, who states that following an investigation order from the Third Military Prosecutor's Office regarding an attack on Carabineros Major Olderolk and the triple assault on the Las Condes Carabineros, the Las Condes Investigations unit, and the Banco del Estado Manquehue branch, one of the members of this extremist cell was being investigated: Arcadia Patricia Flores Pérez, who was allegedly in charge of collecting money from the various Banco del Estado cash registers.

She was the partner of the extremist surnamed Rodríguez and a friend of the accomplices Adalberto Muñoz Jara and Eugenio Cristian Pizarro Piña, who were placed at the disposal of the Third Military Prosecutor's Office on August 28, in case No. 563-81.

On August 16, around 2:30 PM, and based on information provided by the aforementioned detainees, the Brigade moved to Calle Santa Petronila 644, Quinta Normal, in order to arrest the extremist Arcadia Flores.

Upon entering her home, "having seen us through the window facing Calle Santa Petronila, this woman realized that we were security officials; upon knocking on her door which leads to a hallway, she opened it slightly and fired at the officials, for which reason fire was returned, exchanging shots.

A moment of calm followed, some moans were heard, and an isolated shot. Under these circumstances, seeing that they were still firing from inside, I ordered a tear gas canister to be launched so that the occupants would leave the rooms.

Due to the effects of the gas, we had to wait about an hour or two for the effect to pass before raiding the property. Once inside, we found Arcadia Patricia dead, in a supine position, with a firearm at her left side, which later turned out to be the one belonging to the CNI official, Carlos Tapia Barraza." 11.9) On page 111, there is a ruling by the investigating prosecutor suggesting that a partial and definitive dismissal be issued regarding Arcadia Patricia Flores Pérez in relation to the violation of the Arms Control Law, as her criminal liability had been extinguished, and a partial and temporary dismissal regarding the events that caused the death of Arcadia Patricia Flores Pérez, as it was not justified in the records that it was the result of the perpetration of a crime. One of its foundations states: "...it is legally accredited in the records that on the afternoon of August 16, 1981, personnel from the Assault Investigation Brigade of the Investigations of Chile, while attempting to enter a property located at Santa Petronila No. 644 in Quinta Normal for the purpose of conducting a raid, were repelled by gunfire from a woman who was inside, an action that was answered by the Investigations officers, resulting in this woman's death in the confrontation. She was later identified as Arcadia Patricia Flores Pérez, partner of the extremist Guillermo Aurelio Rodríguez Morales, with participation in the death of the C.N.I. official Carlos Tapia Barraza, whose firearm was found next to the corpse of Arcadia P. Flores Pérez, in addition to explosives and other items." On page 113, the aforementioned dismissals were issued, which were appealed and confirmed, on page 117, by the Illustrious Martial Court.
