Case summary
Raimundo Bello Suárez, a merchant with no political affiliation, was detained by a military patrol in May 1974 in the town of Lequena. After remaining tied up and being interrogated for three days, he was extrajudicially executed under the pretext of an attempted escape. His remains were found one year later, and the military justice system classified the crime as aggravated homicide.

Raimundo Bello Suárez died that day due to "homicide," as recorded in his Death Certificate. The registration of his death was decreed by the Second Criminal Court of El Loa, in Calama. The Autopsy Protocol noted that the body showed signs of violence by third parties and injuries caused by a firearm.
The autopsy was performed one year later, when Carabineros found his remains abandoned at the site where he was executed.
The final sentence handed down by the First Military Court, and confirmed by the I. Court Martial, established that Raimundo Bello was detained on suspicion by a military patrol during the second week of May 1974, in the Lequena sector, while he was passing through the area where the patrol was performing guard duties at a reservoir.
He remained detained and tied up for three days at their camp, while he was interrogated by the military personnel and they decided his fate and transfer. On the third day, according to the version provided by those responsible, Raimundo Bello, who had behaved aggressively toward them, attempted to flee by attacking members of the patrol with stones and with kicks and punches.
The Corporal in command of the patrol decided to execute him and, to this end, ordered that he be taken to a ravine, where they forced him to kneel and covered his face with a cap; he then ordered his men to shoot him.
Three civilians residing in the area were eyewitnesses to the homicide. When the investigation began in the Ordinary Justice system following the discovery of the body, they were accused by the carabineros of being the perpetrators of the homicide, and they remained deprived of their liberty until their innocence was established.
The Military Justice system considered the death of Raimundo Bello to be a qualified homicide. In this regard, the sentence stated: "To consider the crime of homicide as qualified, the Court takes into account that, given that the victim was already detained and considering that the perpetrators were heavily armed, there is no doubt that they acted with total security, that is, without leaving the victim any possibility of defending himself, which characterizes treachery, a qualifying element of homicide." The Corporal was sentenced to 10 years and one day of major imprisonment in its medium degree as the perpetrator of the aforementioned crime.
Considering the evidence gathered, the Superior Council reached the conviction that Raimundo Bello Suárez was executed outside of any legal process by State agents, while he was being held deprived of his liberty. For this reason, it declared him a victim of human rights violations.
