VALENZUELA MELLA, OSCAR SANTIAGO: 26 years old, single, employee, died on April 20, 1979, in Santiago. Oscar Santiago Valenzuela Mella died that day at 1:10 a.m., at the intersection of Mac Iver and Avenida Libertador Bernardo O'Higgins, due to a gunshot wound to the chest, as stated in the Death Certificate.
According to information contained in the judicial proceedings, on the night of his death, Oscar Valenzuela was walking with a friend in front of the National Library. At that location, they encountered a group of people, and an argument ensued between them.
One of the members of the aforementioned group fired at Valenzuela Mella and subsequently fled the scene. As a result of the wound, he died immediately. Prior to the events, the perpetrator of the shooting—who had been a member of the Army and an official of the National Intelligence Directorate (DINA)—had been drinking at a restaurant along with other people, among whom were members of the Army and security agents.
The weapon he used was state property, assigned to an active-duty uniformed officer who was present that night and who provided it to the perpetrator upon leaving the establishment. The perpetrator of the crime was sentenced to a custodial sentence by the Court of Appeals.
However, he was never located to be notified of the verdict. Considering the evidence gathered, the Superior Council concluded that the death of Oscar Santiago Valenzuela Mella was due to an abuse of power committed by an individual linked to security agencies, who was provided with impunity by State agents.
For this reason, it declared him a victim of human rights violations. Memoriaviva note: The name of the DINA agent is Hector Sobral Araneda
