The Santiago Court of Appeals rejected the writ of amparo filed by Uruguayan military officer Wellington Sarli Pose, an inmate at the Punta Peuco prison, against the Parole Commission of the appellate court, which had denied his request.

In a unanimous ruling, the Fourth Chamber of the appellate court dismissed any legal infringement in the decision that denied parole to Sarli Posé, who was sentenced to 5 years and one day in prison for his responsibility in the homicide of Eugenio Berríos Sagredo.

According to the Court's resolution, "the psychosocial background reports prepared by the respective prison led to the conclusion that there is no evidence to demonstrate that the petitioner is rehabilitated and corrected for social life, and therefore it denied granting the benefit."

"When the Commission decides to reject parole for not meeting the required good conduct, it does so with knowledge of the content of the aforementioned report on the convicted person, which was the result of interviews and analysis by professionals in the field, even when he met the conduct periods required by law," the ruling continues.

The appellate court further considered that "the challenged decision explained the reasons for denying that request, an aspect which, although not shared by the appellant, is in no way illegal and much less arbitrary or capricious, as it is based on criminological background information emanating from the mentioned reports, which was submitted to the Commission to evaluate the proposal."

Wellington Sarli, military officer linked to the Berríos case, has an international arrest warrant for torturing adolescents

Between April 12 and 15, 1975, Wellington Sarli and other military personnel tortured 39 youths and adolescents, including a 13-year-old girl, at the Treinta y Tres barracks. On that day, the justice system issued an international arrest warrant for this member of the Armed Forces, who was also convicted of the homicide of Eugenio Berríos in 1995.

The news, released this Friday the 9th on MVD Noticias, indicates that the international arrest warrant for Interpol was triggered by the Uruguayan justice system following a complaint of torture against adolescents, which began in 2011.

The news portal Sudestada published the complaint and a chronicle of the events on August 20, 2018. The 39 children and youths were victims of various types of torture, such as the plantón (forced standing), hands tied with wire, deprivation of water and food, the picana (electric cattle prod), the submarino (waterboarding), skin burns with cigarettes, being forced to ride on an iron bar, and beatings.

The complaint described that, on the first night, the crying of the 13-year-old girl, the youngest of the group, provoked the indignation of the other detainees, who requested that they be the ones tortured instead.

Sarli was identified as the cruelest. Ironically, they nicknamed him "jefe chico" (little boss), and he boasted to the minors about interrogating them with his face uncovered.

In addition to Sarli, the complaint includes Rubi Daniel Feola Núñez, Pedro Buzo Correa, Juan Luis Álvez García, Mohacir Leite Urioste (also identified for his cruelty, like Sarli), and Hugo Díaz Agrelo (currently deceased, who was the adolescents' biology teacher as he taught at the city's only high school).

Prosecutor Ricardo Perciballe requested the prosecution of three retired military officers for these crimes against humanity.

Sarli is one of three colonels prosecuted for kidnapping and illicit association in Chile for the kidnapping and homicide of the chemist Eugenio Berríos, who disappeared in 1992 and whose body was found in 1995.

Berríos was a member of the Chilean Directorate of National Intelligence (DINA) during the dictatorship of Augusto Pinochet. The other two colonels are Tomás Casella and Eduardo Radaelli, a collaborator of the senator and leader of Cabildo Abierto, Guido Manini Ríos.
