Samuel Antonio Ponce Silva died that day at 4:30 hours, at the Barros Luco Hospital, due to abdominal and right lower extremity trauma caused by bullets, as stated in the Medical Death Certificate from the Legal Medical Institute. The Autopsy Report adds that he received three bullet impacts.

According to statements made judicially by eyewitnesses, that day, around 2:00 hours, Samuel Ponce was driving a pickup truck along Avenida La Feria in the La Victoria neighborhood, accompanied by two friends.

The vehicle was intercepted by a Carabineros patrol that ordered them to stop, but Samuel Ponce did not obey the order because he did not have a driver's license. The uniformed officers fired a burst of machine-gun fire that disabled the vehicle's braking system, causing it to stop by inertia.

The police officers forcibly removed the driver, threw him to the ground, beat him, and then one of them shot him at point-blank range, striking him three times.

In the judicial process instructed by the Third Military Prosecutor's Office of Santiago, the perpetrator of the acts was sentenced in the second instance to five years and one day of imprisonment, as the author of the crime of unnecessary violence resulting in death.

Considering the background gathered in the investigation carried out by this Corporation, the Superior Council declared Samuel Antonio Ponce Silva a victim of human rights violations by State agents who made irrational use of force.
