On August 2, 1980, business administrator Santiago RUBILAR SALAZAR was killed. The victim had left his home in Santiago on July 26, bound for Valparaíso, from where he was due to return two days later.
He did not. On the day he was scheduled to return, his spouse found their home raided and was detained along with her brother-in-law by CNI agents, being taken to the barracks on Calle Borgoño and interrogated regarding the victim's activities.
It was officially reported that on the aforementioned date, Santiago Rubilar was killed in a confrontation with Carabineros while fleeing in a vehicle, holding its owner and her son hostage. It was stated that a Carabineros officer and the hostages were wounded in the incident, and that Rubilar was wanted for the robbery of bank branches on Calle Santa Elena, which occurred on July 28.
The falsity of the official version is demonstrated by the Exempt Decree of detention that the Ministry of the Interior submitted in the *amparo* (habeas corpus) petition filed on behalf of the victim.
That decree was dated July 20, 1980, that is, before the robberies, and included, in addition to the victim, the people who would later be mentioned as his hostages during the flight on August 2.
In view of these facts, the Commission has reached the conviction that Santiago Rubilar was executed by State agents, in violation of his human rights.
