On September 7, 1986, in the Cajón del Maipo, the following individuals were killed:
Roberto Segundo ROSALES MARTINEZ, 25 years old, 2nd Corporal of the Ejército, belonging to the Infantry branch;
Miguel Angel GUERRERO GUZMAN, 29 years old, 1st Corporal of the Ejército, belonging to the Infantry branch;
Cardenio HERNANDEZ CUBILLOS, 32 years old, 1st Corporal of the Ejército, belonging to the Transport Service as a driver;
Gerardo del Carmen REBOLLEDO CISTERNA, 31 years old, 1st Corporal of the Ejército, belonging to the Infantry branch; and
Pablo Arturo SILVA PIZARRO, 31 years old, 2nd Corporal of the Carabineros, who was part of the security detail for the President of the Republic.
On the indicated day, while Captain General Augusto Pinochet Ugarte, President of the Republic and Commander-in-Chief of the Ejército, and his entourage were returning to Santiago from his residence located in the town of El Melocotón, Cajón del Maipo, they were attacked by an armed group in the Las Achupallas slope sector.
According to information provided to this Commission and evidence contained in the criminal proceedings, the perpetrators of this terrorist attack were militants of the Frente Patriótico Manuel Rodríguez.
They ambushed the presidential caravan by blocking the ends of the convoy with vehicles, preventing retreat, and opened fire on them using automatic weapons, hand grenades, and LAW rockets. As a result, the aforementioned uniformed personnel were killed, having sustained various injuries.
The information examined by the Commission allows for the following conclusions:
The act was planned and executed by members of the Frente Patriótico Manuel Rodríguez, which has even been acknowledged by their own leaders;
The intent of the terrorist act was to produce a political effect and public commotion, and, of course, to kill the Head of State and Commander-in-Chief of the Ejército; and
The action was carried out with the advantage of surprise, which prevented any defense by those affected.
Based on the above, the Commission is convinced that the deaths of 2nd Corporal Cardenio Cubillos, 1st Corporal Miguel Guerrero, 1st Corporal Gerardo Rebolledo, 2nd Corporal Roberto Rosales, and 2nd Corporal Pablo Silva were caused by militants of the Frente Patriótico Manuel Rodríguez, who acted under political pretexts, which constitutes a grave violation of their human rights.
