Ricardo Osvaldo Peña Escobar died that day at 10:00 hours, at Posta Nº 4, due to a thoracic gunshot wound with an exit wound, as stated in his Death Certificate.
According to statements from family members, on the day of the events, a plainclothes Carabineros officer arrived at Ricardo Peña’s home, located in the Galvarino neighborhood of Ñuñoa, and requested that he accompany him to the police station for the purpose of identifying some individuals.
According to the records obtained from the judicial proceedings, while en route to the police facility, the Carabineros officer shot Peña Escobar when he attempted to escape, causing his death.
In the First Military Prosecutor's Office of Santiago, a case was opened for the crimes of illegal detention, illegitimate coercion, and homicide against Ricardo Peña, which was temporarily dismissed.
Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council declared Ricardo Osvaldo Peña Escobar a victim of human rights violations by State agents who made improper use of force.
