On October 5, in the city of Angol, Military Proclamation No. 64 announced that "two terrorists were executed by firing squad for attacking the Barracks." They were:
Ricardo Gustavo RIOSECO MONTOYA, 22 years old, a student at the Universidad Técnica del Estado (UTE) in Santiago, who was in Angol visiting his father, a former communist councilman who was being held in prison;
Luis COTAL ALVAREZ, 15 years old, a primary school student; both without any known political affiliation.
The first of those named had been arrested by a military patrol at his home, and on the way, the same troops arrested the minor Luis Cotal on the street, who was out in public during curfew hours. According to eyewitness accounts known to this Commission, both detainees were taken to a warehouse under construction, where they were beaten and then executed by several gunshots.
The bodies were abandoned in that warehouse overnight and were collected at dawn by a military vehicle. They were never returned to their families.
The Commission cannot consider the official version that the detainees were executed while "attacking a military patrol from the Húsares Regiment of Angol" to be credible, because:
Both individuals had been arrested by military personnel independently of one another, prior to the moment the attack supposedly took place;
It is not credible that two unarmed civilians, one of them only fifteen years old, would attempt to attack a military patrol, and even if that had been the case, there was sufficient time between the moment of arrest and the execution to disarm them, a procedure that is standard in any arrest;
In no case and under no circumstances is it acceptable that their bodies were hidden from their families, which further confirms the irregularity of their deaths.
The Commission thus reaches the conviction that Ricardo Rioseco and Luis Cotal were executed by State agents outside of any legal process and their bodies were hidden, thereby gravely violating their right to life and the right of their families to bury them.
