Rafael Antonio GALLARDO ARANCIBIA, 6 years old, a primary school student, was on the street when he was struck by a bullet that caused his death on September 6. The accounts known to the Commission coincide that the owner of a grocery store repelled an attempted robbery by protesters with gunfire, and one of these bullets struck the minor, who was observing the events.
There was no political motivation on the part of the shooter, who was defending his property. However, the Commission is convinced that the action was provoked by acts of political protest that exceeded the bounds of the legitimate exercise of the right to freedom of expression, as a result of which Rafael Antonio Gallardo fell victim to that situation of political violence.
