Case summary
Rafael Agustín Reyes Gajardo, a 29-year-old Corporal 2nd Class in the Air Force, died from gunshot wounds on October 8, 1973, at the FACH Hospital. He had rejoined his unit only three days earlier following medical leave that coincided with the military coup. Although the institution discharged him due to "death," it denied having records of his passing; he was ultimately declared a victim of the political violence of that era.

Rafael Agustín Reyes Gajardo died that day at 12:30 hours, at the Fuerza Aérea de Chile Hospital, due to gunshot wounds to the pelvis and both thighs, as recorded in the Medical Death Certificate from the Legal Medical Institute.
According to statements made by his relatives, Rafael Reyes, who worked in the Supply section of the Fuerza Aérea de Chile, did not report to his barracks at the time the military coup occurred and only did so on October 5, because he was on medical leave until that day.
According to statements from his spouse, after reporting for duty, he did not return home. Days later, she learned from other relatives that her husband had died at his workplace.
The family sought the advice of a lawyer, who informed them that he had been subjected to a Consejo de Guerra for not having reported to his military unit on 11 de septiembre de 1973.
When consulted, the Undersecretariat of Aviation reported that Rafael Reyes had been discharged by Resolution dated 17 de noviembre de 1973. It clarifies in its official letter that the cause was "death," but that there is no record of the respective summary administrative investigation into his death.
Likewise, the General Command of the Fuerza Aérea Staff reported that: "there are no records in the Hospital, nor in the Fuerza Aérea, regarding the death of Rafael Agustín Reyes Gajardo."
By virtue of the gathered records and the investigation carried out by this Corporation, the Superior Council, despite not having been able to establish the precise circumstances of his death, considering the time and cause thereof, declared Rafael Agustín Reyes Gajardo a victim of the political violence prevailing at the time of his death.
