Pedro Juan Orellana Villa died that day at 21:00 hours, at the Regional Clinical Hospital of Concepción, due to a gunshot wound to the cranium and brain, according to his Death Certificate. That same day, he had been transferred to Concepción from the San Carlos Hospital due to the severity of his condition.
According to statements provided by witnesses, on September 29, 1973, Pedro Orellana left the home of some friends to head to his own residence one hour before the start of the curfew; moments after he had stepped out onto the street, they heard a military patrol pass by and several gunshots.
The following day, Carabineros reported to the San Carlos Court that they had found him wounded at the Municipal Lagoon in that city. The police report stated that «…he was in a supine position among some blackberry bushes and presented injuries to his face and hematomas on both eyes.
In the opinion of the officer who proceeded to recover the injured man, he had been thrown into the blackberry bushes by his captors (…) there were no signs of a struggle at the scene of the incident.»
The Court subsequently dismissed the investigation, considering that «the perpetration of the reported crime is not fully justified in the case files.» The Court of Appeals of Chillán ratified this decision.
Considering the evidence gathered and the investigation conducted, the Superior Council reached the conviction that Pedro Juan Orellana Villa was executed by State agents outside of any legal process. For this reason, it declared him a victim of human rights violations.
