On October 30, 1973, Pedro Antonio FERNANDEZ BURGOS, a 54-year-old street vendor, was killed by military personnel. That day, his spouse had an incident with a neighbor. Following the altercation, the neighbor filed a complaint with the Carabineros in Padre Hurtado, a location where a group of soldiers was present.
Around 4:00 p.m. that day, four soldiers went to the victim's home and proceeded to arrest him along with his spouse. They were taken to the aforementioned unit, where a soldier showed them a paper, which was apparently the complaint, and asked for their opinion on it.
However, as neither of them could read, they did not know what it was about. Faced with their silence, the soldier continued questioning them, becoming increasingly agitated, until he opened a drawer and pulled out a weapon with which he shot Pedro Fernández in the presence of his spouse. They subsequently took him to the Hospital de Peñaflor, where he passed away at 4:25 p.m.
The Commission, based on the statements and evidence received, reached the conviction that Pedro Fernández was executed outside of any legal process by state agents who acted in abuse of power.
