Case summary

On January 31, 1974, the following residents of the Población Lintz, in Puerto Montt, were victims of political execution by Fuerza Aérea personnel:
Pedro Antonio BAHAMONDE ROGEL, 24 years old, employee; Héctor Hugo MALDONADO ULLOA, 26 years old, employee; José Hernán MAÑAO AMPUERO, 22 years old, employee; and José Antonio SOTO MUÑOZ, 23 years old, employee.
In a communiqué issued by the Chief of the State of Siege Zone for the Province of Llanquihue and Chiloé, it was stated that in the early hours of January 31, 1974, "while four individuals detained for assaulting a member of the Armed Forces, who was left seriously injured, were being transported, one of the detainees took advantage of a moment of carelessness by a member of the patrol to seize his rifle and managed to fire it, an incident that the other three prisoners used to lunge at the members of the patrol with clear intentions of seizing their weapons and attacking them.
Faced with this action, the aggression was repelled, resulting in the death of the four prisoners."
Various witnesses indicate that the events began following a minor incident in a bar between some Fuerza Aérea officials and the four civilians identified above, after which the latter returned to their homes.
Shortly thereafter, they were all arrested with great violence in their respective homes by a Fuerza Aérea patrol, beaten in the street, and taken to an unknown destination. Their families only learned of their fate through the communiqué issued by the Military Command.
The Commission formed the conviction that the case described is a grave abuse of power by State agents, involving a violation of the human rights of those affected, as the official version is unacceptable.
It is implausible that four unarmed civilians, recently beaten and in some cases half-naked, during curfew hours, would have attempted an attack against the armed patrol that was transporting them, and that as a consequence of the incident, all of the detainees would have resulted dead.
