In the resolution, Judge Jaime Arancibia identified Carlos Herrera Jiménez, Máximo Lara Lara, Manuel Sergio Aliro Álvarez Lucero, Osvaldo Emilio Fredes Fredes, Manuel José Pastén Vera, and Leoncio Velásquez Guala as the perpetrators of the crimes, due to their responsibility in the consummated crimes of illegal detention, kidnapping, and the application of torture against Pablo Emilio Hernández Dubo, which occurred in 1983.
The judge on extraordinary assignment for human rights violation cases at the Valparaíso Court of Appeals, Jaime Arancibia Pinto, issued an indictment against six former State agents for their responsibility in the consummated crimes of illegal detention, kidnapping, and the application of torture against Pablo Emilio Hernández Dubo, illicit acts perpetrated in October 1983 in Quillota and Viña del Mar.
In said resolution, Judge Arancibia identified Carlos Herrera Jiménez, Máximo Lara Lara, Manuel Sergio Aliro Álvarez Lucero, Osvaldo Emilio Fredes Fredes, Manuel José Pastén Vera, and Leoncio Velásquez Guala as the perpetrators of the crimes.
Based on the evidence gathered during the investigation phase of the case, the visiting judge was able to establish that "on October 13, 1983, the victim, Pablo Emilio Hernández Dubo, was detained by State agents at his home in Quillota."
The document details that the victim "was transported in a car, blindfolded, to the CNI barracks located on Calle Agua Santa or Habana in the city of Viña del Mar. During the journey, he was interrogated by his captors, who struck him with their fists on his head.
When they arrived at their destination, he was taken to an underground area; the interrogations continued, and they subjected him to the 'submarine' [waterboarding], which consisted of them grabbing him by his feet, submerging him in a drum filled with liquid, and pulling him out, repeating this operation until they obtained a confession," while also applying "the telephone," which consisted of blows with open palms to both ears. "He was treated throughout the night with violent punches to different parts of his body.
At dawn the following day, they took him again to a room while he was blindfolded, laid him on a metal bed, known as the 'grill' [parrilla], stripped him, tied him up, and applied electric current."
"He remained in this place for seven days. The victim recognized those who assaulted him at the barracks as the same individuals who carried out his apprehension. As a result of the mistreatment, the victim suffered from severe spinal pain, has damaged vertebrae, and acute disabilities related to the open-palm blows to his ears, along with greater psychological damage; he feels persecuted and could not sleep, thus constituting the crimes of Illegal Detention, Kidnapping with grave injury, and Application of Torture," it adds.
In the resolution, Judge Arancibia finally adds that "Bearing in mind the health situation in the country due to COVID-19 and given that the majority of the accused are elderly, these detainees shall remain in their respective homes, under the custody of the Carabineros of their sector, with the exception of the accused Carlos Herrera Jiménez, who is serving a sentence at the Punta Peuco Prison, while the resolution granting them provisional release is approved, which will be issued subsequently in a consultation procedure before the Valparaíso Court of Appeals."
