Case summary

The Fourth Chamber of the Supreme Court, in a unanimous vote, ordered the state to pay an indemnity of fifty million pesos to the family of Sergio Albornoz Matus, who was shot and killed during a protest on August 30, 1988.
The resolution states that the 14-year-old youth perished due to a bullet impact from a weapon carried by Carabineros officer Miguel Ángel Ortiz, who in 1994 was sentenced by the Court Martial to 541 days of imprisonment as the perpetrator of a quasi-delict of homicide.
The ruling clarified that the state must be held responsible for these events, as the participation of public officials—whose duty was to provide protection to the citizenry—was proven, "and in a reckless and imprudent manner, it was made possible for an agency of the State administration to violate such a precept, with the consequences described above." On August 30, 1988, in the context of a demonstration against Augusto Pinochet, uniformed police personnel attempted to control activists in the commune of La Granja, following the burning of the headquarters of the defunct POH.
The ruling notes that Sergio Albornoz had gone out to buy groceries when he received the bullet impact that caused his death.
