On October 9, 1973, Onofre PEÑA CASTRO, 52 years old, a Councilman of Catemu and a member of the Communist Party, was executed at the La Calavera Tunnel in Llay Llay. He had been detained by Carabineros officers from that same locality and was taken by them to the place where he was executed.

Given that the detention of Councilman Peña by Carabineros officers from Catemu has been verified, that he was never released, and considering the cause of his death, a "gunshot wound to the right hemithorax," this Commission has reached the conviction that Onofre Peña was executed by State agents who violated his right to life.
