On September 27, Nibaldo Cayetano SEGUEL MUÑOZ, a 32-year-old municipal worker, councilman of Mulchén, leader of the Central Unica de Trabajadores (CUT), and member of the Partido Comunista, presented himself voluntarily, accompanied by a former mayor of the same town, to the Mulchén Police Station, where he remained detained.
Two months after the detention, police authorities informed the family's lawyer that they should stop looking for him. To this date, nothing is known about his fate or whereabouts.
Based on the evidence presented, the Commission formed the conviction that the disappearance of Nibaldo Seguel constitutes a human rights violation for which State agents are responsible, given that his detention at the police facility is sufficiently proven and there was no credible explanation regarding his subsequent fate.

REPRESSIVE SITUATION
Nibaldo Cayetano Seguel Muñoz, married, 5 children, municipal worker, Councilman for Mulchén, and communist militant, presented himself voluntarily at the Mulchén Police Station on September 27, 1973, at approximately 18:30 hours, accompanied by the former Councilman and former Mayor of Mulchén, Mr.
Alfredo Kumkar U. Inside the police facility, he was received by Sergeant Pedro Fuentes Llanos, Lieutenant Jorge Maturana Concha, and Sergeant Nery Salazar; the latter slapped the detainee, and they then proceeded to lock him in a cell, all in the presence of his companion.
From the moment of his detention, there has been no information regarding the whereabouts of the affected party, and he remains in the status of forcibly disappeared.
It should be noted that on September 13, his home had been raided by Carabineros who did not present a valid warrant; on that day, Nibaldo Seguel was not at home as he had traveled to Santiago. Before his return to Mulchén, he met with a lawyer in Los Angeles to whom he communicated his intention to turn himself in; two months after the detention, this same lawyer was informed by telephone by a Carabineros officer from Mulchén that they should stop looking for him.

There are no records of legal actions. His family searched for him in all known detention centers in the area. They also appealed to the authorities without obtaining any response regarding the fate or whereabouts of Nibaldo Cayetano Seguel Muñoz.

Visiting Minister Carlos Aldana is in charge of this process for qualified kidnapping, which was transferred to him by the Concepción Court of Appeals.
Although Visiting Minister Carlos Aldana could not carry out all the proceedings he had scheduled in the case regarding the disappearance of five people in Mulchén, VIII Region, they were significant for the progress of this case, which was initially handled by the Criminal Court of that commune.
Throughout Thursday the 29th, Aldana was in Mulchén, where he conducted some confrontations and took statements from witnesses and family members within the framework of a resolution issued by the Concepción Court of Appeals, which on November 16 revoked the first-instance sentence issued by the Mulchén tribunal, which had convicted a former Carabineros officer and three civilians for the qualified kidnapping of Jorge Patricio Narváez Salamanca, José del Carmen Orellana Gatica, Gabriel Valentín Lara Espinoza, Nibaldo Cayetano Seguel Muñoz, and Segundo Hernán Reyes González, events that occurred between September 22 and 28, 1973.
One of the proceedings that was carried out was the statement and confrontation of Felipe Moncada Arroyo, manager of the Association of Fishing Industrialists (Asipes), who appeared for the proceeding with his lawyer, Alejandro Espinoza. However, it was established that the person being confronted did not recognize Moncada.
Although it was not possible to carry out everything that was scheduled, what was done still represented significant progress for this case, in which Minister Aldana must continue to carry out inquiries.
The victims Of the five victims involved in this process, one case is particularly dramatic as it concerns a minor of only 15 years of age. This is Jorge Patricio Narváez Salamanca, who was in his third year of secondary school at the Liceo de Mulchén.
He was detained on September 28, 1973, around 23:00 hours at his home. The captors surrounded the house and entered with great violence. Most were young civilians who collaborated with Lieutenant Jorge Maturana. Nothing more was ever known of his whereabouts.
Another of those affected was Gabriel Valentín Lara Espinoza, also a secondary school student, 18 years old at the time of his detention. This young man was detained on September 22, at midnight, at his home. A group of Carabineros plus a civilian carried out the detention and stated they were acting under the orders of Lieutenant Maturana.
José del Carmen Orellana Gatica, 23 years old, an agricultural worker, was detained on September 23 at his home. The detention was carried out by a group of civilians.
Nibaldo Cayetano Seguel Muñoz, a worker and Councilman for Mulchén, 32 years old, was also a victim of this group. He was detained on September 27, 1973, along with other people. The fifth victim in this case is Segundo Hernán Reyes González.
