On January 18, 1974, Nelson José MARQUEZ AGUSTO, 31 years old, an employee and militant of the Partido Comunista, who had been detained in the city of Iquique, was executed at the Pisagua Prisoner Camp.

Multiple credible and consistent statements from various eyewitnesses indicate that, following the treatment received in prison, the detainee was suffering from mental disturbances. While the prisoners were on a field within the facility, Nelson Márquez "stood up and jumped over a small wall that was around the field.

There was only one conscript guarding all the detainees and he was at a distance. The conscript ran and shouted for him to return. Márquez fled toward the pier area, no more than 50 meters away from the field, hiding under the pier.

They brought him back after about 45 minutes and they were beating him brutally... After about two hours, a burst of gunfire was heard not far from the prison; one of the military personnel said that Márquez had been executed by firing squad."

This Commission is convinced that Nelson Márquez was executed by State agents outside of any legal process after being recaptured, thereby incurring a violation of his fundamental rights.

His body was found in 1990 in the Pisagua mass grave.
