Miguel Emilio Estol Mery died that day at 23:45 hours, at the Hospital del Salvador, due to thoracic-pulmonary and abdominal gunshot wounds, as recorded in the Medical Death Certificate from the Legal Medical Institute.

According to eyewitness accounts, on October 23, Miguel Estol was with his family at his home located on Avenida Manquehue Sur, in the commune of Las Condes. Around 23:00 hours, while the curfew was in effect, a military contingent surrounded the residence, prompting the homeowner to go out to see what was happening.

Upon opening the front door, a soldier opened fire with his weapon, striking him in several parts of his body. The soldiers took the wounded man's body and dragged him to a truck, departing from the scene after asking his spouse for the victim's name, without providing any explanation for what had occurred.

His daughters later learned that their father's body had been dumped in an agonizing state on a public street, at the intersection of Avenida Providencia and Antonio Varas, where he was picked up shortly thereafter by a Carabineros patrol that transported him to the Hospital del Salvador, the facility where he passed away.

Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council reached the conviction that Miguel Emilio Estol Mery was executed by State agents outside of any legal process. For this reason, it declared him a victim of human rights violations.
