On September 17, 1973, the company ELECMETAL had resumed its activities following the events that took place on the 11th of the same month. That same day, the workers restarted their duties in accordance with the request made by the new authorities.

Around 10:00 hours on the aforementioned day, a contingent of carabineros and military personnel arrived at the company and proceeded to selectively detain some of the workers. The detentions were related to the positions they held at the time in the company's union and in the so-called Cordón Industrial Vicuña Mackenna, the geographical sector where the company was located.

The detention took place in the presence of the executives, the owners of the company, and the other workers, among whom was a brother of two of the victims.

The individuals detained in this operation, according to the testimonies and other evidence provided to this Commission, are:

-Augusto Andino ALCAYAGA ALDUNATE, 42 years old, who worked as the company's general accountant and was also the President of the union. He was a member of the Partido Radical;

-José Rosa DEVIA DEVIA, 27 years old, welder, union leader at the company;

-Juan Dagoberto FERNANDEZ CUEVAS, 24 years old, laborer, Secretary of the union and of the Cordón Industrial Vicuña Mackenna. He was a member of the Partido Socialista;

-Miguel Alberto FERNANDEZ CUEVAS, 22 years old, laborer, union coordinator, member of the Partido Socialista;

-José MALDONADO FUENTES, 33 years old, welder.

According to testimonies and other evidence received by this Commission, the five individuals were detained inside the ELECMETAL company by a contingent composed of carabineros and military personnel. They were transported in two different vehicles, one of which belonged to ELECMETAL. The facility to which they were taken and where they were executed remains unknown.

Their bodies were found on a public road and sent to the Instituto Médico Legal by carabineros from the Retén Macul. The date of their deaths corresponds to September 17 between 10:50 hours and 06:30 hours on September 18, with the cause of death in all cases being multiple gunshot wounds.

Considering the circumstances of their detention, the cause of their death, and the fact that the bodies were sent to the Instituto Médico Legal by carabineros, this Commission has formed the conviction that Augusto Andino Alcayaga Aldunate, José Rosa Devia Devia, Juan Dagoberto Fernández Cuevas, Miguel Alberto Fernández Cuevas, and José Maldonado Fuentes were victims of political executions by State agents, constituting a violation of their fundamental rights outside of any legal process or justification.
