Máximo Antonio Roca Pérez died that day at 7:40 hours on a public thoroughfare, due to brain destruction caused by a penetrating gunshot wound to the skull and a gunshot wound to the left hemithorax, as recorded in the Medical Death Certificate from the Legal Medical Institute.
According to statements from family members, on that date Máximo Roca was on provisional release, in a legal proceeding for the crime of assault brought against him in the First Criminal Court of Los Angeles.
According to what was stated by his family, he was killed by military personnel, with his body being found in the Esmeralda lagoon in Los Angeles.
On the same date and in the same location, the lifeless body of Iván Nelson Moya Zurita was also found, who was classified as a victim of human rights violations by the National Commission for Truth and Reconciliation.
Considering the background information gathered and the investigation carried out by this Corporation, the Superior Council reached the conviction that Máximo Antonio Roca Pérez was executed by State agents outside of any legal process, a situation constituting a human rights violation.
