Martín Gustavo Miranda Aguilar died that day at 20:15 hours, at the Puerto Natales Hospital, due to generalized peritonitis and traumatic rupture of the intestine, as recorded in his Death Certificate.
According to statements from family members and evidence obtained from the judicial proceedings, Martín Miranda, a militant of the Partido Socialista, was detained on December 18 by carabineros in Puerto Natales, who tortured him at the police station to which he was taken. After being released, his spouse took him to the local hospital, where he was admitted and subsequently passed away.
The Autopsy Protocol determined that he presented two serious traumatic injuries inflicted by third parties that caused his death.
The judicial proceedings conducted in the Military Justice system were dismissed on the grounds that there was no evidence to hold any specific person responsible as the perpetrator, accomplice, or accessory to the reported crime.
Considering the evidence gathered, the Superior Council reached the conviction that the death of Martín Gustavo Miranda Aguilar occurred as a consequence of the beatings and torture to which he was subjected by State agents during his detention. For this reason, it declared him a victim of human rights violations.
