Museo de la Memoria y los Derechos Humanos[1]

On September 28, 1973, Mario FERNANDEZ ACUM, 20 years of age, was detained by a Carabineros patrol from the Rahue Police Station.

On the day in question, the police patrol arrived at his home in search of him but did not find him. After raiding the residence, they proceeded to the house of a friend where the victim was located. He was detained there and taken away by the carabineros to an unknown destination. Following this, all traces of Fernandez were lost.

It is the conviction of the Commission that the disappearance and final fate of the victim are the responsibility of State agents, who committed human rights violations. This conviction is based on:

-The fact that the detention of the victim by carabineros from the aforementioned police station is proven;

-The fact that after this event, all news regarding his whereabouts and fate was lost;

-The fact that all requests for information made by this Commission to the police authorities have been fruitless.

Relatos de los Hechos

Mario Fernández Acum, 19 years old, a watchmaker and Communist militant, was detained during the night of September 28, 1973, by 10 Carabineros officers who appeared at his home. Among the uniformed officers, the victim's family members were able to identify the Commissioner surnamed Fernández and the Carabineros Gómez, Ampuero, Rosas, Francisco López Novaleski, and Muñoz.

The captors, who according to witnesses were in a state of intoxication, entered the property violently. The victim's family was on the second floor. The Carabineros asked for Mario Fernández, information his family refused to provide.

The victim's mother, Hilda Acum Ruiz, when asked by a police officer to hand over her son, replied... "he is not a dog for me to hand over, nor is he a murderer." This angered the Carabinero, who proceeded to verbally insult Mrs.

Hilda. Then, the Carabinero surnamed Rosas struck her in the chest with the butt of his carbine, throwing her to the ground; immediately afterward, they fired shots beside her. A short while later, the uniformed officers went down to the first floor of the house and this time threatened the victim's father, Roberto Fernández, who also refused to provide the information they required.

Finally, and due to the pressure exerted by the police officers, Rosa Fernández Acum, the victim's sister, told them that he was at a neighbor's house nearby. The Carabineros forced Rosa to accompany them to the indicated house, where they realized the victim had already left.

For this reason, the uniformed officers decided to withdraw. However, as they were doing so, a military man emerged from a neighboring house holding Mario Fernández at gunpoint and handed him over to the police.

They forced him into a yellow pickup truck with punches and kicks and left the scene, taking the victim to the Third Carabineros Station of Rahue, Osorno. The following day, the victim's father went to the 3rd Carabineros Station, where the duty officers informed him that the detainee Mario Fernández was at the Estadio Español.

The family went to the sports facility and confirmed that the victim was not there. The family then returned to the Carabineros station. On this occasion, another officer on duty informed them that no one by the name of Mario Fernández had been admitted the previous night.

With this information, the family members went to the Investigaciones de Chile and other public services without being able to obtain information on the whereabouts and status of Mario Fernández Acum, who currently remains a forcibly disappeared person.

Regarding the situation experienced by the victim's family following his detention, his mother became an alcoholic and died some time later. The father, at the time of this report, was suffering from an incurable disease.

Relatos de los Hechos

Finally, the criminal trial concluded, directed mainly against the most ruthless criminal, a serial killer, who operated in the uniform of the Carabineros in the Los Ríos and Los Lagos regions; this is Colonel (Ret.) Adrián José Fernández Hernández.

I knew him closely, as he spent almost two years as a Lieutenant aide at the Osorno Intendencia (71-72). From there, he was promoted to Captain and took charge of the 3rd Station of Rahue. After the military coup, several popular leaders chose to turn themselves in at the Rahue Station (upon being summoned in military decrees), confident that they would be "attended to" by someone in whom they had a certain degree of trust.

Nothing more was ever heard of them (forcibly disappeared). Fernández has been sentenced ONLY TO FIFTEEN YEARS IN PRISON for being the author of the aggravated kidnapping of: 1. Santiago Domingo Aguilar Duhau, 2.

César Osvaldo del Carmen Ávila Lara, 3. José Mateo Segundo Vidal Panguilef, 4. José Ligorio Neicul Paisil, 5. Flavio Humberto Valderas Mansilla, 6. Lucio Hernán Ángulo Carrillo, 7. Jorge Ladio Altamirano Vargas, 8.

René Burdiles Almonacid, 9. Joel Fierro Inostroza, 10. José Ricardo Huenumán Huenumán, 11. Luis Sergio Aros Huichacán, 12. Arturo Jesús Valderas Angulo, 13. José Rosario Segundo Panguinamún Ailef, 14. Guillermo Ernesto Peters Casas, and 15.

Mario Fernández Acum. For also being the author of the aggravated homicide of: 16. Raúl Santana Alarcón, 17. Gustavo Igor Sporman, 18. Martín Núñez Rosas, 19. Jorge Ricardo Aguilar Cubillos, 20. Edgardo Eugenio Cárdenas Gómez, and 21.

Ester Bustamante Llancamín, For also being the author of attempted aggravated homicide of Blanca Ester Valderas Garrido. For finally being the author of torture against the following political prisoners: 1.

Carlos Hurtado Gallardo, 2. Juan Bernabé Igor Sporman, 3. Luis Orlando Oliveros Angulo, 4. Luis Armando Vargas Coñuel, 5. Juan Orlando Aguilar Angulo, 6. René Orlando Llanquilef Llanquilef, 7. Eliecer Rolando Reyes Gallardo, 8.

Ida Ester Torres Santana, and 9. Leandro Sanhueza Flores. In other words, for being the author of the crime of fifteen aggravated kidnappings (forcibly disappeared), author of six aggravated homicides (political executions), author of another attempted aggravated homicide, and author of crimes of torture against nine political prisoners, the murderer and torturer ADRIÁN JOSÉ FERNÁNDEZ HERNÁNDEZ has been sentenced to serve only a sentence of FIFTEEN YEARS IN PRISON.

One more example of JUSTICE WITH CLEMENCY, "to the extent possible." FOR ITS PART, the State of Chile has not compensated either the families or the surviving victims. As a lawyer, I sponsored the complaints for the nine cases of torture included in the conviction of Fernández.

It is worth imagining that I personally could have been one more case among the forcibly disappeared. Indeed, by order of Commissioner Fernández, I was detained on 09/13/1973, at my home, in a Carabineros operation, and I remained for 24 hours in the cells of the Rahue Carabineros Station.

The police report filed by Fernández led to my conviction in a War Council in Osorno. The terrible torture to which he subjected Mr. Juan Orlando Aguilar Angulo (RIP) was intended to force him to testify, accusing me of terrorist actions and alleged possession of explosives that could justify a death sentence against me.

Fortuitous circumstances prevented it. Finally, after two years in prison, I was expelled from Chile with a sentence of banishment. I was able to return from exile, from Sweden, in 1997. The criminal Adrián Fernández Hernández is still at liberty on bail.
