: That, given the probative merit of the evidence brought to this case and recorded in the previous finding, which constitute judicial presumptions that meet the requirements of Article 488 of the Code of Penal Procedure, the following facts can be established: ..... e) That upon the arrival of said delegation at the pier, Major Ríos ordered that the detainee Jorge Vilugrón be removed from the boat where he remained injured and be transported to said pier by the carabineer Héctor Leoncio Andrade Calderón and other undetermined persons, a place where he was tied to public lighting pole No. 35, a hood was placed over his head, and the army reserve corporal José Erwin Maricahuin Carrasco proceeded to place a red disk on his chest, while about 20 meters away, the firing squad composed of five uniformed men was positioned, among whom were the carabineers César Miguel Letelier Letelier (currently deceased), José Carlos Tocol Navarro, and conscript soldiers who had been designated by Major Ríos during the previous night to compose said squad, noting that the carabineer César Letelier (deceased) replaced the carabineer Luis Oyarzo Villegas as a rifleman, who had been originally designated, due to the latter having fallen asleep, and the non-commissioned officer Luis Alberto Pineda Muñoz was designated to give the order to lower the saber, the signal for the squad to fire. Behind the firing squad were the priest Giampiero Vigano, the Civil Registrar Rolando Riffo Díaz, the person in charge of the health post Rubén Poblete Jara, the detainee Reinaldo Carrasco, and near Vilugrón Reyes, Major Ríos. f) That at 07:10 hours on the aforementioned day of October 8, 1973, Major Ríos gave the order for non-commissioned officer Pineda to lower the saber, which he did, causing the squad to fire, and upon verifying that he was still alive, Major Ríos approached the prisoner and delivered the coup de grâce to his left temple with his private .32 caliber Rubi Extra revolver, which he took from a holster he was carrying, certifying the death of Vilugrón Reyes and registering his death in the Civil Registry of Puerto Cisnes, as stated in the Death Registration Certificate on page 2241, which indicates the cause of death as “executed by firing squad” and “to be buried at sea”; Major Ríos having desisted from executing the detainee Reinaldo Carrasco on the same previous occasion, who did witness the execution of Vilugrón Reyes.

A.- Puerto Cisnes Case
I.- Rejects the preliminary and special pleas of res judicata, amnesty, and statute of limitations filed by the defense of the accused Ramón Cárcamo Pérez and José Maricahuín Carrasco. II.- Acquits Eladio Rodolfo Zárate Mora, Luis Segundo Oyarzo Villegas, and Pablo Enrique Leiva Orellana of the charge brought against them as perpetrators of the crime of aggravated homicide.
III.- Sentences José Carlos Tocol Navarro and Luis Alberto Pineda Muñoz as perpetrators of the crime of aggravated homicide against Jorge Orlando Vilugrón Reyes, perpetrated on October 8, 1973, at the Puerto Cisnes pier, to the penalty of three years and one day of minor imprisonment in its maximum degree, accessory penalties of absolute perpetual disqualification for political rights and absolute disqualification for public offices and positions during the term of the sentence, and payment of costs.
Grants them the benefit of supervised release, making the required credits. IV.- Sentences César Humberto Henríquez Reuquén, Héctor Leoncio Andrade Calderón, and Ramón Hernán Cárcamo Pérez as accomplices to the crime of aggravated homicide against Jorge Orlando Vilugrón Reyes, perpetrated on October 8, 1973, at the Puerto Cisnes pier, to the penalty of five hundred and forty-one days of minor imprisonment in its medium degree, accessory penalties of suspension from public office or position during the term of the sentence, and payment of costs.
Grants them the benefit of conditional remission of the sentence, making the required credits.

II.- That José Erwin Maricahuin Carrasco is sentenced as the perpetrator of the crime of aggravated homicide against Jorge Orlando Vilugrón Reyes, perpetrated on October 25, 1973, at kilometer 26 of the Puerto Aysén - Coyhaique road, Villa Los Torreones sector, to the penalty of 5 years of minor imprisonment in its maximum degree, the accessory penalty of absolute perpetual disqualification for political rights, and absolute disqualification for public offices and positions during the term of the sentence, and payment of the costs of the case.
