Manuel Alberto Burgos Muñoz died that day at 20:30 hours, at the Hospital Regional de Temuco, due to shock, as stated in the respective Death Certificate. The Autopsy Report adds that the cause of death originated from a transfixing gunshot wound to the right lumbar-abdominal area, with extensive visceral rupture.
According to statements provided by witnesses, that day, around 17:00 hours, while Manuel Burgos and his family and friends were returning from swimming in a sector of the Cautín river, which was accessed through a property belonging to the Regimiento de Tucapel, they were ordered by military personnel to leave the area.
As they were withdrawing, Manuel Burgos, who had separated from the rest of the group and was continuing along another path within the military compound, was wounded by shots fired by the military. He was transported to the hospital facility by the same personnel, where he passed away hours later.
According to the official version from the Ejército, a fire had been reported at the location, due to which the patrol ordered all civilians present to leave the property. However, upon proceeding to detain a suspect who was walking through Isla Cautín, the individual fled, which led a soldier to warn him twice by firing into the air.
As he did not stop, "a member of the patrol fired at his body, striking him in the lumbar region."
Considering the evidence gathered and the investigation carried out by this Corporation, the Superior Council reached the conviction that, by not having employed more rational means to attempt the detention of Manuel Alberto Burgos Muñoz, the State agents engaged in an excessive use of force. For this reason, it declared him a victim of human rights violations.
