Manuel Abraham Rivera Duque died that day at 3:47 a.m., on Calle Salomón Corbalán in front of No. 5640, Población 12 de Mayo, due to two thoracic-cervical gunshot wounds with exit wounds, as recorded in the Medical Death Certificate from the Legal Medical Institute.
According to the statement provided by his spouse in the criminal complaint, Manuel Rivera was struck by projectiles fired by a military patrol after failing to obey an order to halt during the curfew, while he was traveling in a vehicle with a friend. The latter, who was also wounded during the incident, later recounted what happened to the family members.
The proceedings initiated in the Second Criminal Court of San Miguel were temporarily dismissed in 1975 and reopened in 1992; the case remained in that status at the time it was examined by the Superior Council.
Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council, taking into account the circumstances, the period, and the cause of death, declared Manuel Abraham Rivera Duque a victim of the prevailing political violence.
