On September 18, Luis Hilario HERMOSILLA MUÑOZ, 45 years old, a driver for a high-ranking leader of the Partido Comunista and a militant of that party, was killed.

He was detained at his home on September 17 by Carabineros officers, who took him away stating that they needed him to hand over the vehicle he drove, which was parked a few blocks from that location.

His family searched for him unsuccessfully in various facilities until September 22, when they found his body at the Instituto Médico Legal. The death certificate indicates the cause as: "Craniocerebral gunshot wound with projectile exit"; Location: public thoroughfare; and date: September 18, 1973.

Given that his detention by State agents is documented; his death by gunshot wounds is confirmed; and taking into consideration his political militancy and professional activity, this Commission has reached the conviction that Luis Hilario Hermosilla was executed by State agents who violated his right to life.
