On November 15, 1973, Luis Heriberto CONTRERAS ESCANILLA, 43 years old, an electrical technician and member of the Partido Socialista, was killed.
On November 10, Contreras Escanilla was arrested at his home by a military patrol, who also arrested one of the victim's sons, albeit at a different location. Both were taken to the Cerro Chena detention center.
The press reported that he had been apprehended for "suspicious acts." On November 15, 1973, according to witness statements provided to this Commission, after having been tortured during his detention, he was executed by two gunshots by military personnel inside Cerro Chena.
His body was abandoned on a public road, from where it was sent to the Legal Medical Institute. The torture and the cause of death were fully corroborated in the autopsy report, which noted multiple injuries and abrasions.
Having established the detention, the victim's confinement in a military facility, the torture inflicted, and the fact that he was killed by gunfire while in custody, and given that there is no record of any judicial proceeding or Consejo de Guerra having been held against him, the Commission reached the conviction that the death of Luis Contreras constitutes a case of human rights violation, as he was executed outside of any legal process by state agents.
