Luis Eugenio Labbé Peñaloza died that day at 22:25 hours, at the San Fernando Hospital, due to septicemia from a gunshot wound to the splenic flexure of the colon, as certified by his Death Certificate.
According to information provided by his mother, in the early hours of January 30, 1976, during the hours of the curfew, Luis Labbé was at a restaurant in the city of San Fernando with a group of friends.
As the young men stepped out onto the street, an incident occurred with a military patrol and members of the Carabineros. One of the latter fired, and a projectile struck Luis Labbé. He was taken to the San Fernando Hospital, where he passed away days later.
Following these events, a case was opened at the Military Prosecutor's Office of Colchagua-San Fernando. Upon requesting its retrieval from the archives of the Third Military Court, the court reported that the case file could not be found.
Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council declared Luis Eugenio Labbé Peñaloza a victim of human rights violations committed by State agents who made reckless use of force.
