Luis Gaete Celis died that day at 18:50 hours, in San Bernardo, due to a gunshot wound to the cranium, as recorded in his Death Certificate.
According to statements made by family members, on June 3, 1974, Luis Gaete had been drinking with a friend at several establishments in the center of the San Bernardo commune. A relative of the latter stated that they were traveling in a pickup truck owned by him, and as they were driving past a military facility located on Calle Arturo Prat in San Bernardo, they were stopped by the conscripts on guard duty.
After they exited the vehicle, the friend lost his balance and fell forward; at that moment, one of the conscripts fired a shot that struck Luis Gaete, causing his instantaneous death. His friend was arrested and charged with driving under the influence.
Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council declared Luis Gaete Celis a victim of human rights violations committed by a State agent who made improper use of force.
