Luis Marcelo Benaiges Albert died that day at 16:00 hours, on a public thoroughfare, from two gunshot wounds with exit points, one to the face and cranium and the other to the thorax, as certified by the Medical Death Certificate from the Legal Medical Institute.
According to information provided by a family member, Luis Benaiges was a militant of the Partido Socialista and a driver for the organization. He resided in the Villa Convital in Maipú and was found dead on Avenida José Pedro Alessandri, in Macul; the circumstances surrounding his death remain unknown.
Considering the evidence gathered and the investigation conducted, the Superior Council, although unable to establish the precise circumstances of his death, took into account his political militancy, the role he held at the time, and the cause of his death, and declared Luis Marcelo Benaiges Albert a victim of the prevailing political violence.
