The visiting judge also applied to Lillo Morandé and Villanueva Zeballos the accessory penalties of absolute perpetual disqualification from public offices and political rights, and absolute disqualification from holding professional titles for the duration of the sentence, as well as the payment of court costs.
The extraordinary visiting judge for human rights violation cases of the La Serena Court of Appeals, Vicente Hormazábal Abarzúa, sentenced Ricardo Lillo Morandé to 15 years and one day of imprisonment and José Luis Villanueva Zeballos to 10 years and one day of imprisonment—both retired Carabineros officers—as perpetrators of the qualified homicide of Héctor Marín Álvarez, José Héctor Luque Schurman, and Benjamín Garzón Morillo, perpetrated on September 23, 1973, in the Salar del Carmen sector, on the route between Calama and Antofagasta.
In the ruling (case file 6-2011), the visiting judge also sentenced Domingo Márquez Pérez to 3 years and one day, and Nelson Alarcón Muñoz to 541 days, both as perpetrators of repeated crimes of simple kidnapping, committed on September 22, 1973, against Héctor Marín Álvarez, José Héctor Luque Schurman, and Benjamín Garzón Morillo in the town of Baquedano.
The visiting judge also applied to Lillo Morandé and Villanueva Zeballos the accessory penalties of absolute perpetual disqualification from public offices and political rights, and absolute disqualification from holding professional titles for the duration of the sentence, as well as the payment of court costs.
Regarding civil reparations, the State and Ricardo Lillo Morandé, José Luis Villanueva Zeballos, Domingo Márquez Pérez, and Nelson Alarcón Muñoz were ordered to pay compensation of $60,000,000 (sixty million pesos) to each of the plaintiffs for moral damages.
During the investigation stage of the case, Judge Hormazábal Abarzúa was able to establish the following facts: “That, on September 22, 1973, after being released on bail due to lack of evidence in case file No. 7640 of the Second Criminal Court of Calama regarding smuggling, Héctor Marín Álvarez, José Héctor Luque Schurman, and Benjamín Garzón Morillo traveled by taxi from the city of Calama to Antofagasta.
In the town of Baquedano, in the afternoon, they were detained by police officers—an officer and subordinate personnel—from the Baquedano Carabineros station, and hours later, they were removed by police from the Carabineros Intelligence Service (SICAR), composed of Captain Arturo Carol López Argandoña (deceased) and subordinate personnel, who transported them in a pickup truck to the city of Antofagasta, where they killed Héctor Marín Álvarez, José Héctor Luque Schurman, and Benjamín Garzón Morillo with multiple firearm shots, around 3:45 a.m. on September 23, 1973, on the side of the road in an area known as Salar del Carmen.”
