The Fourth National Day of Protest took place on August 11 and August 12, 1983. Twenty-five deaths occurred within that framework. Three took place in the regions and the remainder in the capital.
On this occasion, according to official information, 18,000 soldiers took charge of public order throughout the capital, alongside Carabineros and Investigaciones. A curfew was in effect starting at 18:30 on the 11th.
The testimonies received generally account for the conduct of the military, who made frequent use of firearms. Military personnel often exceeded the use of force by confronting disturbances exclusively with firearms and without possessing police experience in maintaining public order. This excess was reflected in the number of victims.
Eliseo Enrique PIZARRO ROJAS, 50 years old, a worker in the Minimum Employment Program (PEM), and Lina Dora del Carmen GARAY TOBAR, 44 years old, a housewife, died under identical circumstances. On the night of the 11th, both were mortally wounded by bullets that pierced the light-material walls of their homes in the Montedónico neighborhood (Valparaíso) when an incident occurred as uniformed personnel intervened to control public order, firing weapons.
The Commission, given the context of the Fourth Day of Protest, in addition to the testimonies received regarding the actions of State agents in this case, presumes that there was an excessive use of force, violating the human rights of Eliseo Enrique Pizarro and Lina Dora del Carmen Garay.
