Lina de las Mercedes Gómez Hidalgo died that day at 0:50 hours, at the Instituto de Neurocirugía, due to craniocerebral trauma, as certified by the Medical Death Certificate from the Instituto Médico Legal.

According to witness statements, at 23:30 hours on October 31, 1988, Lina Gómez, her spouse, and their minor children were traveling by car along Avenida Vicuña Mackenna when they were struck by a pickup truck traveling at high speed.

At a red light, the truck stopped and an argument ensued. Lina Gómez got out and approached the driver's door, inserting her right arm through the window. The driver started the vehicle, dragging her for approximately 60 meters. She subsequently fell to the pavement, sustaining serious injuries and later dying at a medical facility.

On November 2, 1988, the pickup truck appeared parked at the Vigésima Comisaría of Carabineros. It was retrieved by its driver, an official of the Fuerza Aérea de Chile, without it being possible to seize the vehicle. One month later, he was detained by Investigaciones, being identified and recognized by witnesses.

According to judicial statements provided by officials of the Policía de Investigaciones, the intervention of the Fuerza Aérea prevented his detention.

The Court issued an indictment against the uniformed officer as the perpetrator of the quasi-delict of homicide. However, up to the moment the Superior Council examined the case, it had not yet been possible to notify him of said resolution.

Considering the evidence gathered, the Superior Council reached the conviction that the death of Lina de las Mercedes Gómez Hidalgo was caused by a State agent who abused his power, acting outside the scope of his duties and without being legally sanctioned, an act constituting a human rights violation.
