HAVING SEEN: In these proceedings, Case No. 54-2009, on the docket of the Court of Appeals of Chillán, by the judgment issued by the Extraordinary Visiting Judge Claudio Arias Córdova on April 12, 2011, which appears on pages 770 to 780, the following individual was sentenced: Aldo Patricio Leiva Rojas to four years of minor imprisonment in its maximum degree, with the accessory penalties of perpetual absolute disqualification from political rights and absolute disqualification from public offices and positions for the duration of the sentence, and to pay the costs of the trial, for his responsibility as the perpetrator of the kidnapping of Jaime del Carmen Espinoza Durán , beginning on October 11, 1973, in the city of Chillán, with the benefit of supervised release granted to him.

In a split decision, the justices of the Second Chamber rejected the appeal for cassation filed by Aldo Leiva Rojas against the judgment of the Court of Appeals of Chillán and the Visiting Judge, Claudio Arias.

The highest court sentenced the man to 4 years of imprisonment for his responsibility as the perpetrator of the qualified kidnapping of the 22-year-old, following an altercation with military personnel in October 1973, and he was also granted the benefit of supervised release.
