On November 7, 1980, Rubén Eduardo ORTA JOPIA and Juan Ramón OLIVARES PEREZ, an electrical technician and a laborer respectively, both militants of the MIR, died in Santiago.
According to the official version, at 1:20 a.m., CNI personnel intercepted a Citroën vehicle traveling along Avenida Domingo Santa María at Puente Vivaceta. Two individuals were traveling in the vehicle who, according to this version, were presumably attempting to attack the CNI barracks located nearby, having fired a burst of machine-gun fire at the security agents as they approached.
It is noted that various weapons were found in the vehicle.
However, statements received by this Commission indicate that both victims had been detained earlier that day by CNI agents.
The version that the victims had attempted to attack a CNI barracks while traveling in an old Citroën, and that after the agents approached on foot none of them were wounded by the burst of machine-gun fire allegedly fired at them, is also implausible. Furthermore, the bodies showed clear signs of having been subjected to torture.
For all these reasons, the Commission has reached the conviction that Rubén Eduardo ORTA and Juan Ramón OLIVARES were executed by CNI agents, in violation of their human rights.
