On November 18, 1973, Juan Fernando MILLAS VELIZ, 31 years old, a mechanic, was killed. The individual in question was driving his Citroneta along Gran Avenida heading south on the night of November 17, when, as he passed in front of the 12th Precinct of the Carabineros, police officers from that facility fired upon him, leaving him wounded.
He was transported to the Barros Luco Hospital, where he died at 05:00 hours on the morning of November 18 due to a "transfixing thoraco-abdominal gunshot wound," fired "from a long distance," according to the autopsy report.
The version provided by the Carabineros in the corresponding police report maintains that Millas was traveling during curfew hours, which was the reason they proceeded to fire at him. However, it is recorded in the admission documents of the aforementioned hospital that Millas arrived wounded at 23:05 hours, while the curfew began at 23:00 hours, which makes the authorities' claim implausible.
In accordance with the above, this Commission has formed the conviction that Juan Fernando Millas was a victim of the excessive use of force by State agents, which caused his death.
