Case summary

On October 16, 1973, Juan Estanislao MATULIC INFANTE, 19 years old and a member of the Socialist Party, was killed by Carabineros stationed at the Calama Police Station.
The Commission did not obtain precise information regarding the date and cause of the victim's detention. The official version provided by the Carabineros states that Juan Matulic was executed while attempting to escape from his place of arrest, the Calama Police Station.
Notwithstanding the above, and even accepting the official version regarding the attempted escape, the Commission reached the conviction that in this case, there was an excessive and unnecessary use of violence against Juan Matulic, resulting in his death at the hands of State agents.
This conviction is based on the circumstance that it does not appear reasonable or necessary to have shot to kill a person who was attempting to escape from a police station heavily guarded by personnel specially trained to repress such actions through the use of force appropriate to the situation they intended to prevent.
