José Tomás Mora González died that day at 9:15 hours, at the Hospital Sótero del Río, due to a right pulmonary gunshot wound, as certified by his Death Certificate.
According to records obtained from the judicial proceedings and press reports from the time, on December 2, 1989, at 8:00 hours, in the El Ombú neighborhood of the La Pintana commune, a group of approximately four people were involved in an incident with the driver of a bread delivery truck.
Due to these events, Carabineros personnel from the 42nd Radio Patrol Precinct arrived at the scene, where they proceeded to open fire and detain individuals.
According to statements from an eyewitness, José Mora attempted to flee the scene and was wounded in the back by a shot fired by a Carabineros officer who was pursuing him.
The case brought before the Second Military Prosecutor's Office of Santiago was dismissed, as it was deemed that there was insufficient evidence to attribute his death to a specific person.
Considering the evidence gathered in the investigation conducted by this Corporation, the Superior Council declared José Tomás Mora González a victim of human rights violations committed by an agent of the State who, having more rational and less violent means to detain him, made excessive use of force.
