Case summary

José Manuel Paredes Trujillo died that day at the Third Carabineros Precinct of Maullín due to asphyxia by aspiration of vomit, as certified by the Medical Death Certificate from the Legal Medical Institute.
According to witness statements, on November 4, at approximately 19:00 hours, José Manuel Paredes was heading to his home. Under these circumstances, he was forced, under false pretenses, to board a Carabineros vehicle that was passing through the area.
The uniformed officers took him to the Third Carabineros Precinct of Maullín, where they beat him repeatedly, causing injuries that led to his death.
Carabineros officially informed the family in writing that José Paredes had been arrested for public intoxication and taken to the police station, where he lost consciousness. For this reason, he was transferred to the Maullín Hospital, where he died from aspiration of vomit. However, the hospital stated that Paredes Trujillo arrived at the facility already dead.
Considering the evidence gathered by this Corporation, the Superior Council reached the conviction that the death of José Manuel Paredes Trujillo was due to the beatings and torture to which he was subjected during his detention by State agents. By virtue of this, he was declared a victim of human rights violations.
