Case summary

On September 14, 1973, José Eusebio RODRIGUEZ HERNANDEZ, a 24-year-old laborer and militant of the Movimiento de Izquierda Revolucionaria (MIR), was executed by firing squad.
According to press reports, he was tried by a Consejo de Guerra (War Council) and executed by military personnel in compliance with the sentence issued by said body. He was accused of being the lieutenant of "Mickey," the name by which a high-ranking leader of the MIR was known.
No copy of the alleged Consejo de Guerra has been obtained, despite requests made by the Commission to the corresponding authorities. His death certificate indicates the date of death as September 14, 1973, and the cause of death as "multiple gunshot wounds."
Given the unrefuted press information and the cause of death, and despite the lack of information regarding the circumstances of his arrest, this Commission has reached the conviction that José Eusebio Rodríguez died as a result of a political execution carried out by State agents outside of any legal process, thus making him a victim of a violation of his human rights.
