2. CASES OF DEATHS DUE TO IMPROPER USE OF FORCE OR ABUSE OF POWER WITH THE TOLERANCE OF THE AUTHORITY FOR WHICH CONVICTION WAS REACHED
a) Methodological warning
Due to the scarcity of background information and evidence that could be gathered, and the fact that these were isolated situations, which hinders their contextual analysis, the cases of death due to the indicated causes receive a different treatment than the rest of the cases declared with conviction by this Commission.
This consists of mentioning only the names of the victims in this part of the Report, without including an account of each one of them.
This is without prejudice to their inclusion, in the same terms as the other cases with conviction, in Volume II of this Report.
b) Different types of cases included in these causes.
b.1) Deaths due to improper use of force b.1.1) Deaths due to excessive use of force
This category includes cases in which there was a lack of proportionality between the force used by the authority and the situation that it was intended to prevent, which in principle justified its use.
Among the deaths due to excessive use of force, it is worth noting, among others:
– Those caused by shots fired by State agents, often without prior warning, against unarmed passersby who, instinctively, fled upon seeing them approach;
– Those caused by disproportionate forms of repression, mainly shots, often without prior warning, carried out by State agents against people who were only participating in public demonstrations or distributing propaganda in opposition to the military regime;
– Those caused by shots fired by State agents, often without prior warning, against people who were only violating the curfew, without any other sign of danger;
– Those caused by shots fired by State agents, also often without prior warning, against people who were surprised while committing a crime that did not rationally require such a measure.
It is necessary to point out that the military or police institutions dismissed the officials involved in most of these cases, passing the background information to the Military Courts, which is irrelevant for the purposes of their classification as human rights violations.
