Case summary
José Eduardo Astudillo González, a 22-year-old POJH worker, died in December 1983 after being wounded during a workers' demonstration in the commune of La Granja. He died as a result of craniocerebral trauma caused by the impact of a tear gas canister launched by the Carabineros, and he is recognized as a victim of the political violence of that period.

On December 5, 1983, workers from the Occupational Program for Heads of Households (POJH) held a collective demonstration in front of the La Granja Municipality. José Eduardo ASTUDILLO GONZALEZ, 22 years of age, was killed.
Carabineros intervened to disperse the demonstration by launching tear gas canisters. Credible witnesses state that one of these canisters struck him violently in the head. A few days after this incident, José Eduardo Astudillo passed away at the Neurosurgery Hospital due to "cranial-encephalic trauma complicated by bilateral confluent bronchopneumonia."
Given the circumstances of the death and considering that the use of tear gas canisters by Carabineros constitutes a proportionate means of controlling public order, without evidence of improper use in this case, this Commission is convinced that José Eduardo Astudillo fell victim to the political violence that characterized the period.
