José Antonio Rivera Ramírez died that day at 2:00 hours, at the Carabineros station in Andacollo, due to asphyxiation by suffocation and acute alcoholism, as stated in the Medical Death Certificate from the Legal Medical Institute.
On the night of September 19, 1986, José Ramírez was detained for public intoxication by Carabineros officers at the Parque La Laja in Andacollo, while he was attending the "La Pampilla" festival.
He was taken to the local Carabineros station, where, according to eyewitnesses, he was beaten by his captors on several occasions because he was asking to be released. After the beating, he was placed in a holding cell, where he died.
The Autopsy Protocol states that the death was caused by asphyxiation by suffocation, due to obstruction by external obstacles over the respiratory orifices, and indicates the existence of other traumatic injuries.
Considering the evidence gathered, the Superior Council concluded that the death of José Antonio Rivera Ramírez occurred as a consequence of the mistreatment and beatings to which he was subjected by State agents during his detention, and declared him a victim of human rights violations.
