José Ananías Zapata Carrasco died that day at 22:15 hours, at the Hospital de Coyhaique, due to a gunshot wound to the head of a homicidal nature, as recorded in his Death Certificate.
According to statements made by family members, José Zapata was detained near noon at a small farm in Bahía Jara by two plainclothes Carabineros officers, accused of an alleged theft of livestock. In judicial statements, eyewitnesses to the events indicated that when they went to handcuff him, José Zapata attempted to flee.
His captors, without prior warning, fired at him, striking him in the back. Afterward, one of the uniformed officers shot him again in the head. He was transported to the Hospital de Coyhaique, where he passed away hours later.
A judicial investigation was initiated at the Military Court of Coyhaique, in which one of the officers was prosecuted. However, the case was subsequently temporarily dismissed on the grounds that the events did not constitute a crime.
Considering the evidence gathered and the investigation conducted by this Corporation, the Superior Council declared José Ananías Zapata Carrasco a victim of human rights violations by State agents who made irrational use of force.
