José Aladino Alvear Ortega died that day, on a public thoroughfare, due to shock from acute anemia caused by multiple gunshot wounds "by military action" (sic), as recorded in the corresponding Medical Death Certificate from the Legal Medical Institute. The same mention appears in the Autopsy Protocol.
A copy of the Autopsy Protocol is attached to an investigation initiated in the Second Criminal Court of Temuco, following a complaint filed by the National Commission for Truth and Reconciliation regarding the disappearance of five people. This expert report contains a record that, on that date, the Legal Medical Institute sent the original Protocol to a Military Prosecutor's Office.
When consulted, the Fourth Military Court of Valdivia reported that it has no record of the requested information, as "these were events that occurred during a state of emergency, the jurisdiction of which corresponded to War Tribunals."
The Superior Council, considering the time and cause of death, and especially the notation in the Medical Death Certificate and the Autopsy Protocol attributing authorship to State agents, reached the conviction that José Aladino Alvear Ortega was executed outside of any legal process. By virtue of this, it declared him a victim of human rights violations.
